MUARATEBO - AS (46) tahun, Ketua Badan Permusyawaratan Desa (BPD) Desa Tambun Arang Kecamatan Sumay, Kabupaten Tebo diminta untuk menyerahkan diri. AS terlibat kasus pengrusakan ringan yang telah divonis oleh Pengadilan Negeri (PN) Tebo selama 3 bulan penjara.
" Kita minta saudara AS serahkan diri ke Kejaksaan," kata Kepala Kejaksaan melalui Kasi Pidana Umum (Pidum), Yoyok Adi Saputra. Rabu (25/09/2019).
Yoyok mengatakan, terpidana kasus pengrusakan ringan tersebut hingga saat ini belum menjalani hukuman. " Putusan hukuman terhadap terpidana AS sudah mempunyai kekuatan hukum tetap. Jadi kita minta kepada beliau untuk segera menyerahkan diri," kata Yoyok lagi.
Yoyok menjelaskan, bahwa terpidana sempat melakukan uapaya hukum dengan melakukan banding ke Pengadilan Tinggi Jambi. Pada keputusannya, banding ditolak dan terpidana tetap menjalankan hukuman.
" Tindakan pidana yang dilakukan oleh terpidana adalah tindakan pengrusakan ringan, sehingga yang menyidangkan perkara itu adalah penyidik. Tetapi vonis terpidana telah memiliki kekuatan hukum tetap, eksekusi tetap dilakukan oleh pihak kejaksaan," terangnya.
Pada Selasa (24/09) kemarin lanjut Yoyok, berdasarkan surat perintah Kepala Kejaksaan Tebo pihaknya ingin melaksanakan eksekusi terhadap terpidana. Dimana berdasarkan informasi dari masyarakat menyatakan jika terpidana akan melakukan musyawarah kordinasi dan konsolidasi BPD bersama pemerintahan Desa Tambun Arang. Kegiatan tersebut dilaksanakan di rumah atau kediaman Plh Kades Tambun Arang.
" Ada keanehan di situ, dimana dari informasi masyarakat bahwa undangan tersebut ditandatangani langsung oleh terpidana. Jadi kita berpendapat jika terpidana bakal hadir pada kegiatan itu," ujarnya.
Akan tetapi lanjut dia, saat akan dilaksanakan eksekusi tim yang dipimpin langsung oleh Yoyok ini mendapatkan penghalangan dari beberapa warga yang dianggap melindungi terpidana.
" Karena situasi yang tidak kondusif, kita kembali ke Polsek Sumay untuk minta bantuan. Dibantu anggota Polsek, kita kembali melakukan eksekusi. Sayangnya terpidana sudah tidak ada ditempat," jelasnya.
Selanjutnya, Yoyok melakukan koordinasi dengan masyarakat. Dia minta kepada masyarakat bila menemukan terpidana agar segera menyerahkan diri dengan tidak ada upaya paksa. " Yang bersangkutan sudah kita panggil berkali-kali untuk datang ke kejaksaan. Kita minta yang bersangkutan menjalankan hasil keputusan yang telah memiliki kekuatan hukum tetap," ucapnya.
Saat ditanya apakah terdakwa telah masuk dalam Daftar Pencarian Orang (DPO), Yoyok mengatakan, saat ini belum karena masih menunggu niat baik terdakwa. Tapi dengan adanya kejadian ini, kami akan memanggil terdakwa lagi, tapi kalau juga tidak datang, terdakwa akan kita masukan kedalam DPO kejaksaan. Kepada masyarakat, kami minta agar tidak menghalang-halangi kerja kami, karena itu bisa dipidanakan," pungkasnya. (Zie)
