JAMBI - Effendi Hatta, Zainal Abidin dan Muhamadiyah menjalani sidang lanjutan suap Ketok palu Kamis (27/2/2020) dengan agenda pembacaan vonis.
Dalam pembacaan putusannya, majelis hakim menyimpulkan bahwa ketiga terdakwa secara sadar melakukan perbuatan yang melanggar hukum dan terbukti ketiganya masuk dalam kategori sebagai pelaku.
"Dengan ini Terdakwa satu Zainal Abidin, Efendi Hatta, dan Muhammadiyah terbukti bersalah. Dengan itu menjatuhkan hukuman masing-masing selama empat tahun penjara dan denda Rp200 juta. Dan hukuman tambahan, dicabut hak politiknya selama lima tahun setelah bebas dari penjara. Dan juga untuk Effendi Hatta dikenakan denda Rp100 juta," kata hakim ketua membacakan putusan.
Adapun yang memberatkan adalah ketiga terdakwa secara sadar menerima uang suap yang jelas jelas melanggar hukum. Dan juga para terdakwa tidak mendukung peran pemerintah dalam pemberantasan tindak pidana korupsi, serta terdakwa telah merusak tatanan pengesahan RAPBD Jambi dengan cara menerima suap.
Sedangkan perbuatan yang meringankan terdakwa karena telah mengakui semua perbuatannya dan mau berterus terang dihadapan majelis hakim dan mengembalikan uang suap yang telah diterima ke KPK sesuai dengan jumlah yang diterima.
Dalam Amar putusan majelis hakim, terdakwa dinilai sebagai penyelenggara negara meskipun bukan pegawai negeri sipil, tetapi malah menerima hadiah janji atau hadiah.
Dengan demikian maka telah terpenuhi unsur pidana sebagai mana diatur dalam 12 huruf a Undang-Undang Republik Indonesia Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi sebagaimana telah diubah dengan Undang-Undang Nomor 20 Tahun 2001 tentang Perubahan Atas Undang-Undang Nomor 31 Tahun 1999 tentang Pemberantasan Tindak Pidana Korupsi juncto Pasal 55 ayat (1) ke-1 KUHPidana juncto Pasal 64 ayat (1) KUHP.
"Tiga terdakwa juga sudah mengakui jika menerima uang suap untuk pengesahan RAPBD Jambi secara bertahap dari Kusnindar," sebut hakim.
