BATANGHARINEWS.COM, Solo - Sabtu 1 Mei 2021 mantan Hakim Mahkamah Konstitusi yang mengeluarkan pendapat berbeda atau Dissenting Opinion dalam putusan pembubaran BP Migas 2012 lalu, Harjono mengatakan Perlunya dibentuk Lembaga independen tetapi berada dibawah eksekutif berupa badan otorita untuk keberlangsungan Industri Hulu Migas di Indonesia.
Hal tersebut disampaikan Harjono dalam Forum Group Discussion (FGD) di Universitas Negeri Sebelas Maret, Sabtu, (1/5), Bersama sejumlah akademisi fakultas hukum diantaranya Dekan Fakultas Hukum UNS Prof. Dr. I Gusti Ayu Ketut Rachmi H., SH, MM, praktisi migas Ir. Benny Lubiantara, SE, MM. dan ahli hukum energi Dr. Lego Karjoko, SH, MH.
Menurut Harjono, Sudah banyak bentuk otorita di negara ini yang dberikan kewenangan sebagai eksekutif untuk mengelola, seperti Badan Otorita Batam, Otoritas Jasa Keuangan dan lainnya.
“Melalui lembaga Otoritas maka pengelolaan hulu migas akan selaras dengan putusan
Mahkamah Konstitusi dan memberikan keleluasaan dalam mengelola untuk sebesar-besarnya kemakmuran rakyat,” kata Harjono.
Harjono menjelaskan negara berkontrak dengan swasta itu tidak mendegradasi posisi negara contohnya ketika negara membeli alutsista itu kontraknya tidak B to B tetapi B to G. “Itu tidak masalah,” kata Harjono.
Sementara itu, Dekan Fakultas Hukum Universitas Sebelas Maret (UNS), Prof Gusti Ayu menegaskan keputusan Mahkamah Konstitusi (MK) setara dengan undang-undang yang harus dipatuhi. Gusti Ayu menilai pemerintah harus taat pada undang-undang sehingga harus menjalankan putusan Mahkamah Konstitusi.
“Negara harus segera melaksanakan putusan MK guna menjamin ketahanan energi sebagai tanggung jawab negara kepada rakyat sebagai pemilik kedaulatan,” tegas Ayu.
Prof Gusti Ayu mengatakan implementasi putusan MK harus dilakukan dengan membuat naskah akademik untuk RUU Migas yang baru harus segera disiapkan agar meningkatkan trust baik dari dalam maupun luar negeri.(*)
